Report by a controversial government lawyer of the time. Lambertson defended the United States Government in a lawsuit brought forth by the Ponca Indians, led by Chief Standing Bear. The Ponca has attempted to return to their native Nebraska lands from their displacement lands in Indian Territory. Upon their return to Nebraska, they were held by General George Crook at Fort Omaha and ordered to return to Indian Territory. Chief Standing Bear then petitioned the courts for his right to return home. The court's duty was to determine whether an Indian had the rights of freedom guaranteed by the U.S. Constitution. Lambertson tried to prove that an Indian was neither a person, nor a citizen and, therefore, did not have the right to bring suit against the government. Lambertson was unsuccessful in his attempt to dehumanize Native Americans.
